Regelwerk 7. Filmkreis Shorts

ALLGEMEINES

  • Die Filmkreis Shorts existieren, um Film, Kunst und Kultur zu fördern und werden von Freiwilligen des Studentischen Filmkreises an der Technischen Universität Darmstadt e.V. (im Folgenden “Filmkreis” genannt) ausgetragen.
  • Aus allen eingereichten Filmen wird eine Vorauswahl getroffen, die im Programm der 7. Filmkreis Shorts Veranstaltung vor Publikum gezeigt wird und um Jury- und Publikumspreise konkurriert.
  • Dieses Regelwerk wird mit der Einreichung eines Filmes und dem damit verbundenen Zahlen der Anmeldegebühr von der einreichenden Person anerkannt. 
  • Eingereicht werden dürfen nur Filme, bei denen die einreichende Person an Regie oder Produktion mitgewirkt hat oder von diesen Stellen autorisiert wurde. Ferner gelten die folgenden Bedingungen:
    • Die Laufzeit des eingereichten Filmes darf maximal 20 Minuten 59 Sekunden betragen.
    • Das Produktionsjahr des eingereichten Filmes muss 2022 oder später sein.
    • Alle Filme müssen in deutscher oder englischer Sprachfassung oder mit deutschen oder englischen Untertiteln eingereicht werden.
    • Der eingereichte Film darf nicht im Rahmen einer vergangenen Filmkreis Shorts Veranstaltung gezeigt worden sein.
    • Filme, bei denen stimmberechtigte Mitglieder des Filmkreises mitgewirkt haben, sind von der Teilnahme an den Wettbewerben um die Preise ausgeschlossen.

EINREICHUNGSMODALITÄTEN

  • Der Zeitraum der Einreichung beginnt am 01.10.2024 und endet spätestens am 21.10.2024. 
  • Da die 7. Filmkreis Shorts von Freiwilligen organisiert und veranstaltet werden, die nur begrenzte freie Zeit zum Sichten jeder einzelnen Einreichung haben, behält sich der Filmkreis vor, den Einreichungszeitraum zu verkürzen, wenn die Anzahl der eingereichten Filme eine intern festgelegte Schwelle übersteigt.
  • Für jeden eingereichten Film ist eine Anmeldegebühr fällig. Dessen Betrag ist auf filmfreeway.com einsehbar.
  • Filme können ausschließlich über filmfreeway.com eingereicht werden.

PREISE

Es werden je drei Publikums- und Jurypreise verliehen.

Alle eingereichten Filme, die in das Programm der 7. Filmkreis Shorts Veranstaltung aufgenommen werden, nehmen am Wettbewerb um diese Preise teil.

Jurypreise

Der erste Jurypreis ist mit einem Preisgeld in Höhe von 300€ dotiert, der zweite mit 200€ und der dritte mit einem Preisgeld von 100€.

Die Gewinner werden vor der Veranstaltung ausgewählt. Die verleihende Jury besteht aus 3 bis 5 Personen, die vom Filmkreis ernannt werden.

Publikumspreise

Der erste Publikumspreis ist mit einem Preisgeld in Höhe von 200€ dotiert, der zweite mit 125€ und der dritte mit einem Preisgeld von 75€.

Der Publikumspreis wird am Ende der Veranstaltung vom Publikum vergeben.

RECHTE

Rechteeinräumung für Vorführzwecke

  • Mit der Einreichung erklären sich die Rechteinhaber einverstanden, dass der Film unentgeltlich im Rahmen der 7. Filmkreis Shorts gezeigt werden darf.
  • Die einreichende Person wird darüber informiert, falls der Film für die 7. Filmkreis Shorts ausgewählt wurde. Nach Erhalt dieser Information kann der Film noch innerhalb von 14 Tagen zurückgezogen werden. Bei einem Rückzug werden keine Kosten zurückerstattet.
  • Die einreichende Person bestätigt mit der Einreichung, dass sie die nötige Vertretungsmacht hat, um diesen Bedingungen zuzustimmen. 

Rechteeinräumung für Werbezwecke

  • Mit der Einreichung wird bestätigt, dass der Filmkreis Filmausschnitte (bis zu 60s), einzelne Frames und Credits, sowie jegliches weiteres angefragtes Material zum eingereichten Film zu Werbezwecken der 7. Filmkreis Shorts nutzen darf.

Garantie auf Rechtskonformität & Haftungsausschluss

  • Die einreichende Person garantiert, dass alle Inhalte des Films, sowie dessen Vorführung im Rahmen der Filmkreis Shorts, nicht gegen deutsches Recht, insbesondere die Rechte Dritter (z.B. Urheber-, Leistungsschutz-, Persönlichkeits-, Namens-, Markenrechte) verstoßen.
  • Die einreichende Person übernimmt die volle Haftung für die Nutzung des jeweiligen Films.
    Der Studentische Filmkreis an der Technischen Universität Darmstadt e.V. wird diesbezüglich von allen Ansprüchen Dritter wegen einer Nutzung des Films freigestellt. Dies umfasst auch die notwendigen und angemessen Kosten einer Rechtsverteidigung.
    Der Gerichtsstand ist Darmstadt.

SICHTUNGSKOPIE

Um am Wettbewerb teilnehmen zu können, ist die einreichende Person verpflichtet, dem Filmkreis eine Kopie des Films über die Plattform filmfreeway.com zum Zwecke der Sichtung zur Verfügung zu stellen.

VORFÜHRKOPIE

Im Falle, dass ein eingereichter Film für das Programm der Filmkreis Shorts Vorstellung ausgewählt wird, ist die einreichende Person verpflichtet, dem Filmkreis eine Vorführkopie digital zur Verfügung zu stellen. Der Download wird in Absprache zwischen dem Filmkreis und der einreichenden Person vereinbart. Die einreichende Person trägt alle dabei potenziell entstehenden Kosten.

Die Vorführkopie sollte im qualitativ bestmöglichen Format zum Zwecke der Vorführung vor Publikum vorliegen und muss folgende Kriterien erfüllen:

  • Als DCP:
    • Geometrische Auflösung: max. 4k
    • Audio: max. 7.1 Kanäle
    • Als 7z oder zip verpackt
  • (alternativ) Als Videodatei:
    • Codec: ProRes / H265 / H264 / AV1 
    • Container: MKV / MOV / MP4
    • Geometrische Auflösung: max. 4k
    • Audio: max. 7.1 Kanäle
    • möglichst mit sha1/md5-Prüfsumme beigelegt

Sollte von der einreichenden Person kein DCP zum Film zur Verfügung gestellt werden, behält sich der Filmkreis das Recht vor, aus dem zur Verfügung gestellten Material ein DCP zu erstellen.

REISEKOSTENUNTERSTÜTZUNG

Jede Person, die nachweislich an einem Film mitgewirkt hat, der im Rahmen der 7. Filmkreis Shorts gezeigt wird, kann bis zum 14.03.2025 für die Anreise zur Veranstaltung eine Beteiligung des Filmkreises an den Reisekosten beantragen. 

Nach Bestätigung des Antrags durch den Filmkreis müssen bis zum 13.04.2025 alle Belege der entstandenen Reisekosten eingereicht werden. 

Pro Film werden maximal 150€ (bei Anreise aus dem Ausland maximal 250€) zur Kostendeckung ausgezahlt. Dieser Betrag wird dabei auf maximal 4 Personen pro Film verteilt. Sollte die Summe der Reisekosten von allen Beteiligten an einem Film über dem oben genannten maximal auszahlbaren Betrag pro Film liegen, wird die Auszahlung proportional nach Beitrag zu den Gesamtkosten auf die jeweiligen Personen aufgeteilt.

Sofern sowohl der initiale Antrag genehmigt, als auch alle eingereichten Belege als rechtens anerkannt wurden, erfolgt die Auszahlung bis spätestens 01.05.2025.

SCHLUSSBESTIMMUNGEN

Sollte dieses Reglement unwirksame oder undurchführbare Regelungen enthalten oder nach Zustimmung durch Einreichung unwirksam oder undurchführbar werden, bleibt die Wirksamkeit des Reglements im Übrigen unberührt.

Der Filmkreis ist verpflichtet, die unwirksame Bestimmung durch eine wirksame zu ersetzen, die dem Ziel der Filmkreis Shorts unter Berücksichtigung der Interessen beider Parteien (dem Filmkreis & der einreichenden Person), sowie der Fairness im Wettbewerb um die ausgeschriebenen Preise am nächsten kommt.

Ebenso ist zu verfahren, sollten sich ergänzungsbedürftige Regelungslücken zeigen.

 

 

 

7th Filmkreis Shorts: Rules and Regulations

GENERAL RULES & INFORMATION

  • The Filmkreis Shorts exist to promote films, art and culture. They are run by volunteers of the ‘Studentischer Filmkreis an der TU Darmstadt e.V.’ (hereafter referred to as ‘Filmkreis’), a non-profit organization in close cooperation with the University of Darmstadt.
  • Only a pre-selection of all submissions will be shown to an audience at the 7th Filmkreis Shorts event and compete for the jury- and audience prizes.
  • By submitting a film and paying the associated entry fee, the submitting person agrees to the terms and conditions of this rulebook
  • The submitting person may only submit films in which they were a director or producer or have been authorized by one of these authorities. The following further conditions apply:
    • The running time of the submitted film may not exceed 20 minutes 59 seconds.
    • The film has to have been in production in 2022 or later.
    • All films have to be submitted in English or German or with English or German subtitles.
    • Films that have been previously shown at a Filmkreis Shorts event are not eligible for submission.
    • Films with involvement from voting members of the Filmkreis and/or jury are excluded from all competitions for prizes.

SUBMISSION MODALITIES

  • The timeframe for submissions begins on October 1st 2024 and ends on October 21st 2024 at the latest.
  • Because the Filmkreis Shorts are run by volunteers with limited free time to look over every individual submission, we reserve the right to shorten the timeframe for submissions, if the total amount exceeds a certain threshold.

  • Films can only be submitted via filmfreeway.com

PRIZES

There are three jury and three audience prizes, the winners of which are announced at the event.

All submitted films that have been selected to be shown as part of the 7th Filmkreis Shorts event will compete for the following prizes:

Jury Prizes

The first jury prize is endowed with prize money of 300€, the second with 200€ and the third with 100€.

The winners will be picked before the event. The awarding jury consists of 3 to 5 people appointed by the Filmkreis.

Audience Prizes

The first audience prize is endowed with prize money of 200€, the second with 125€ and the third with 75€.

The winners will be picked by the audience at the end of the event.

RIGHTS & LEGAL REQUIREMENTS

Granting of Rights for Screening Purposes

  • With the submission of a film, the rights holder(s) grant us permission to show the film free of charge as part of the 7th Filmkreis Shorts event.
  • The submitting person will be informed if the film has been selected for the 7th Filmkreis Shorts. After receiving this notice, the film can still be withdrawn within 14 days. No costs will be refunded in the event of withdrawal.
  • The submitting person confirms through the act of submission that they have the necessary authority to agree to these conditions.

Granting of Rights for Marketing Purposes

  • With the submission of a film, the Filmkreis is granted the rights to use clips (up to 60s), still frames, credits and further requested material regarding the submitted film for promotional purposes of the Filmkreis Shorts.

Guarantee of Legal Conformity & Disclaimer of Liability

  • The submitting person guarantees that the entire contents of the submitted film, as well as its screening as a part of the 7th Filmkreis Shorts event do not conflict with German Law and especially the rights of third parties (e.g. copyright, …).
  • The submitting person assumes full liability for the usage of their respective film.
    The     Studentische Filmkreis an der Technischen Universität Darmstadt e.V. is exempted from all third party claims arising from the usage of the respective film. This includes the necessary and appropriate costs of a legal defense.
    The place of jurisdiction is Darmstadt, Germany.

EVALUATION COPY

In order to take part in the competition, the submitter has to provide an evaluation copy of the respective film via filmfreeway.com for the purpose of evaluating the submission.

SCREENING COPY

If a submitted film is selected to be shown at the 7th Filmkreis Shorts event, the submitter has to provide the Filmkreis with a high quality screening copy through digital means. This copy will be shown to the audience of the event on our silver screen. Details regarding the exchange of said copy will be discussed individually. Possible correlated costs are to be paid by the submitter. 

As previously mentioned, the screening copy should be provided in the highest possible quality, fulfilling the following criteria:

  • As a DCP:
    • Geometric resolution: max. 4k
    • Audio: max. 7.1 channels
    • Compressed as 7z or zip
  • (alternatively) As a video file:
    • Codec: ProRes / H265 / H264 / AV1 
    • Container: MKV / MOV / MP4
    • Geometric resolution: max. 4k
    • Audio: max. 7.1 channels
    • preferably accompanied by a sha1/md5-checksum 

In cases where no DCP is provided, the Filmkreis reserves the right to create one from the provided material. 

REIMBURSEMENT OF TRAVEL EXPENSES

Every person that attends the event and is a verifiable contributor to a film shown at the event, is eligible for a reimbursement of their travel expenses.

Requests for a reimbursement must be submitted by March 14th 2025 to be recognized.
If the Filmkreis confirms the request, proof for all travel expenses (e.g. receipts) must be submitted by April 13th 2025.

Reimbursements are limited to a maximum of 150€ per film (250€ in cases of international travel) and can only be split between up to 4 people.
In cases where the sum of travel expenses for every person of a respective film exceeds the above mentioned maximum permitted payout per film, the reimbursements will be split proportionately to how much each person contributed to the total.

If both the initial request is accepted and the proof of expenses has been deemed valid, the requester will receive their payout by May 1st 2025.

SEVERABILITY

Should one or more provisions in this rulebook become invalid or unenforceable, the validity of the remaining conditions is retained.

The Filmkreis is required to replace any invalid provisions with valid ones that are aligned with the purpose of the Filmkreis Shorts, while taking the interests of both parties (Filmkreis & the submitter) into account and ensuring fairness in the competition for the advertised prizes.

The same applies should gaps in the regulations become apparent that require supplementation.
